These Terms of Service (“Terms”) apply to all services provided by Barber & Lyon Media Services (“we”, “our”, “the Company”). By requesting or using our services, you agree to these Terms.

1. Services Provided

We provide website design, website development, hosting, maintenance, support, digital content creation, and related services. The specific services included depend on the plan you select.

2. Payment & Billing

  • A one-time setup fee applies to all plans.
  • Weekly subscription payments begin once the website build is approved or after 14 days — whichever comes first.
  • Payments are billed weekly via direct debit, card billing or invoice (depending on agreement).
  • Failure to make payments may result in suspended hosting or removal of the website until payment is made.

3. Minimum Term

All plans require a minimum 12-week commitment. After this period, services convert to a month-to-month arrangement and may be cancelled with notice.

4. Ownership of Website

  • You own the website content you provide (text, images, logo, etc.).
  • We own the website design, code, and framework until the contract is fully paid out.
  • If a plan is cancelled before the minimum term is complete, we reserve the right to retain the website files.

5. Content & Responsibilities

You are responsible for supplying all business details, images, logos, and written content unless otherwise agreed.

6. Support & Updates

  • All plans include small updates and content changes (5–10 minute tasks).
  • Larger feature changes or redesigns may require additional billing.
  • We aim to respond to support requests within 1–3 business days.

7. Domain Names & Email

You may supply your own domain name or request that we register one on your behalf. Email services may be provided through third parties such as Google Workspace or cPanel.

8. Limitation of Liability

We are not responsible for downtime, loss of data, security breaches, or damages caused by third-party systems, hosting providers, or user error.

9. Termination

After the minimum term, you may cancel your plan with written notice. Outstanding invoices must be paid before transferring website files or access.

10. Changes to Terms

We may update these Terms at any time. Continued use of our services means you accept any revised version.
